Borough, Pavilion reach agreement on terms of new lease for the boardwalk mainstay
It could give you whiplash. The Borough of Avon, after its governing body voted two weeks ago to suddenly revoke the lease of the Avon Pavilion and then defended that position with various and changing reasons despite pushback from Pavilion supporters, voted Monday to reinstate the lease for another 10 years at a heavily attended, standing-room only meeting. The vote of the three-member Board of Commissioners was 2-1 in favor and followed a 20-minute closed session at the top of the meeting. Commissioner Frank Gorman cast the lone vote against. Avon Borough, Pavilion began talks over abrupt revocation of the lease for the boardwalk restaurant
Avon Borough officials and the owner of the Avon Pavilion are at least one step closer an agreement after the two had an hourlong sit down on Thursday to discuss the controversy surrounding the longtime boardwalk restaurant. Rob Fishman, pavilion owner, and Avon Borough Administrator Tim Gallagher spent about an hour on Thursday talking about the gulf that separates Fishman and the majority of the elected officials in town regarding the rebuilding of the Avon Pavilion. The lease between the borough of Avon and the owners of the Avon Pavilion was illegal, and Hurricane Sandy provided the town the impetus it needed to finally terminate it, Avon Mayor Robert Mahon said Monday. At an afternoon workshop session of the Avon Board of Commissioners attended by an audience of about 70 mainly supporters of Rob Fishman, Avon Pavilion owner, Mahon interjected into a public comment period his reasons for making the controversial move a week ago. In a surprise move, the commissioners on Jan. 28 voted 2-1 to revoke the Pavilion’s lease, claiming state law mandated voiding lease agreements on structures destroyed by an act of nature, such as Hurricane Sandy. Owners of Avon Pavilion did not cause Hurricane Sandy, attorney says
The Borough of Avon apparently thinks that Robert Fishman, the owner of the Avon Pavilion, single-handedly caused Hurricane Sandy, his attorney says. In a strongly worded letter to Avon Borough officials, Wall Township-based attorney Dennis A. Collins said there is no other reason to terminate the restaurant’s lease, because the agreement between the borough and Fishman says it is the town’s responsibility to rebuild the restaurant if it is destroyed by an act of nature. The Avon Pavilion’s lease was suddenly terminated by the Board of Commissioners by a 2-1 vote on Monday. Longtime Avon restaurateur Rob Fishman, owner of the Avon Pavilion, went to Borough Hall on Monday to show officials new blueprints for rebuilding the boardwalk mainstay. He left without a restaurant. Fishman said he sat down with Tim Gallagher, borough administrator, to talk about his new plans to rebuild the pavilion after Hurricane Sandy destroyed the restaurant that stood at 600 Ocean Avenue for 23 years. Gallagher was grim, Fishman said. He had just received a resolution by fax to be added to Monday’s Board of Commissioners meeting.
