The owners of the business have extra shields against liability, whether it’s civil or criminal,” says Marcia Greenberger, co-president of the National Women’s Law Center. “In this instance, we have a set of for-profit corporations that want all the benefits of [incorporation], but they want the most person-type recognition of a religion that one can imagine. There’s a reason why this has never been found to exist so far under the law.” This case threatens personal rights in a way that parallels the backlash against civil rights, said Louise Melling, deputy legal director of the American Civil Liberties Union. “Once civil rights acts were passed, there really were businesses and schools that said they should be exempt based on religious principles. But we said no. That’s not how we think about religious freedom in this country.”
